1. Scope of Application

These Terms and Conditions ("Terms") govern all orders placed with EG Aluminum (operating as EG Pergola) ("EG Pergola", "we", "us" or "our") through the online store at https://egpergola.ca, as well as orders placed by phone, email, in one of our showrooms or through a written quote accepted by you.

By placing an order, you ("Customer", "you" or "your") agree to these Terms together with our Shipping & Returns Policy, Privacy Policy and Cookie Policy, which form part of the agreement between us. Please read them carefully before ordering. If you are purchasing as a consumer, nothing in these Terms limits the rights you have under the consumer protection laws of your province or territory.

2. Contract Partner and Formation

2.2 Product listings on our website, quotes and draft orders are an invitation for you to place an order. They are not a binding offer by us.

2.3 When you complete checkout (for example by clicking "Pay now" or "Complete order") or accept a quote in writing, you make an offer to purchase. A binding contract is formed only when we send you an order confirmation by email. An automated acknowledgement that we have received your order is not an acceptance.

2.4 Please review your order confirmation as soon as you receive it. If the model, dimensions, colour, options, quantity or delivery address differ from what you intended, contact us right away so we can correct the order before production or shipping begins. Once production of a custom or made-to-order item has started, changes may not be possible or may incur additional cost.

2.5 We may cancel an order, before or after confirmation, if it was based on a pricing error, typographical mistake, technical error or incorrect stock information, or if we reasonably suspect fraud. If we cancel, we will notify you and refund any amount you have paid to your original payment method.

3. Products, Images and Specifications

3.1 We sell aluminum louvered pergolas (Piano and Equa), aluminum carports, side screens, sliding shutters, infrared heaters, LED lighting kits, related accessories and custom or made-to-order configurations of these products.

3.2 Product images, 3D renders, configurator previews and showroom displays are illustrative. Colours and finishes may differ from what you see on screen because of display settings, lighting and manufacturing tolerances of powder coating. If an exact colour match is important, request a colour sample before ordering.

3.3 Dimensions, weights, wind and snow load ratings and other specifications are given on the product pages and in the installation guides. Small deviations may occur within normal manufacturing tolerances. Load ratings assume installation exactly as described in our installation guide on a suitable foundation.

3.4 Most products are supplied as kits that require assembly. Assembly requirements, tools and the number of people recommended are stated in the installation guide available on the product page or on request.

3.5 We do our best to keep availability information accurate, but we do not guarantee that a product will be in stock or available for production at the time you order. If we cannot supply an item, we will tell you as soon as possible and refund any payment made for it.

4. Prices and Taxes

4.1 All prices are in Canadian dollars (CAD). Unless stated otherwise, prices exclude shipping. Shipping costs are shown at checkout after you enter your delivery address, or on your written quote, before you pay.

4.2 Applicable sales taxes (GST, HST, QST or PST, depending on your delivery address) are calculated and shown at checkout or on the quote.

4.3 The price payable is the price displayed at the time we receive your order, subject to correction of obvious errors as described in section 2.5. If we discover a pricing error after you have ordered, we will contact you and offer you the choice of reconfirming at the correct price or cancelling for a full refund.

4.4 Promotional or sale prices apply only to orders placed during the stated promotional period and cannot be applied retroactively. Quotes are valid for the period stated on the quote.

5. Payment

5.1 Payment is processed through Shopify Payments and the payment methods displayed at checkout. By choosing a payment method, you agree to the terms of the relevant payment provider.

5.2 Payment is taken in full at the time of order unless we have agreed in writing to a deposit and balance schedule for a custom project. Where a deposit arrangement applies, the balance must be paid before the order is shipped.

5.3 Ownership of the products remains with EG Aluminum until we have received payment in full. Risk of loss or damage passes to you when the products are delivered to the address on your order.

6. Shipping and Delivery

6.1 We ship across Canada by freight carrier. Standard delivery is curbside or driveway delivery by appointment; you or an adult representative must be present to receive and sign for the goods. A liftgate is used where available. Delivery to raised areas, backyards, or locations requiring special equipment or extended carrying is not included and may cost extra.

6.2 Delivery dates are estimates only and may be affected by production schedules, carrier capacity, weather and other factors outside our control. We are not liable for losses caused by delays, but we will keep you informed and you may cancel an order that has not shipped if a delay is unreasonable.

6.3 You must inspect the shipment on delivery, note any visible damage on the carrier's delivery document, and report damage or missing parts to us with photos within 48 hours of delivery. Concealed damage must be reported within 7 days. Full details are in our Shipping & Returns Policy.

7. Cancellation, Returns and Refunds

7.1 You may cancel an order free of charge at any time before production of a custom item has started or before the order has shipped, whichever comes first. Contact us by email with your order number.

7.2 Standard (non-custom) products may be returned within 14 days of delivery if they are unused, unassembled and in their original packaging. You arrange and pay for return freight unless the item was defective or not what you ordered. A restocking fee of up to 15% may apply to opened but unused standard items.

7.3 Custom-size, custom-colour, custom-height and made-to-order items are produced specifically for you and cannot be returned once production has started, except where they are defective or do not conform to your order.

7.4 Approved refunds are issued to the original payment method within 10 business days of our inspection of the returned goods.

8. Custom and Made-to-Order Products

8.1 When you order a custom configuration, you are responsible for confirming all dimensions, mounting type, colour, options and site conditions before we confirm the order. We manufacture to the specifications on your order confirmation.

8.2 Lead times for custom items are estimates and are communicated on the product page, in your quote or in your order confirmation.

8.3 Once production has started, custom items cannot be cancelled, changed or returned, other than for defects or non-conformity with your order.

9. Permits, Site Suitability and Customer Responsibilities

9.1 Permits. You are solely responsible for determining whether a building permit, zoning approval, condominium or homeowners' association approval, heritage approval or any other authorization is required for your installation, and for obtaining it at your own cost. We do not obtain permits and do not guarantee that a product meets the requirements of any municipality or building code.

9.2 Site suitability and foundations. You are responsible for confirming that the installation site, ground conditions, deck, patio, wall or roof structure are suitable for the product and can support its weight and the loads stated in the specifications. Footings, concrete pads, anchoring and any structural work must be designed and completed by you or your contractor in accordance with local codes.

9.3 Electrical work. Motors, LED kits, infrared heaters and other electrical components must be connected by a licensed electrician in accordance with the Canadian Electrical Code and provincial requirements. Damage caused by improper electrical connection is not covered by warranty.

9.4 Installation guides. You must follow the installation guide supplied with the product and any written instructions we provide. Do not exceed the stated wind and snow load ratings; close or open louvers as recommended in high winds or heavy snow, and clear accumulated snow as instructed.

9.5 Utilities and property. Before drilling or excavating, locate underground and in-wall utilities. We are not responsible for damage to your property or to utilities during installation.

10. Installation

10.1 Unless an installation service is expressly agreed in writing, our products are supplied for installation by you or your contractor at your own risk. We are not a party to any agreement between you and an installer and are not responsible for the installer's work, scheduling, pricing or conduct.

10.2 Before starting installation or hiring an installer, check that all boxes have arrived, that the parts list is complete and that no parts show visible damage. Do not install damaged or incorrect parts; contact us first. Costs of installation, removal or re-installation are not covered by us unless we have agreed to them in writing.

10.3 Where we agree in writing to provide installation, the scope, price, site preparation requirements and schedule will be set out in a separate written quote or agreement that forms part of the contract.

11. Warranty

11.1 Subject to the full warranty terms published on the product pages, EG Pergola products carry a limited warranty of:

  • 5 years on the aluminum structure and powder coating; and
  • 2 years on mechanical and electrical components, including motors, LED lighting and remote controls.

11.2 The warranty period starts on the date of delivery. Your order confirmation is your proof of purchase.

11.3 The warranty does not cover damage or defects caused by improper installation or installation not in accordance with our guide; loads exceeding the stated wind or snow ratings; modifications or use of non-original parts; improper electrical connection; accidents, misuse or neglect; damage from chemicals or improper cleaning; or normal wear and cosmetic changes such as minor scratches and fading consistent with normal weathering.

11.4 To make a claim, email info@egaluminum.ca with your order number, a description of the issue and clear photos or video. Where a claim is accepted, we will, at our option, repair the product, supply replacement parts or replace the product. Labour for removal or reinstallation is not included unless agreed in writing.

11.5 The warranty is a voluntary commitment by EG Aluminum in addition to, and not a substitute for, the legal warranties and statutory rights you have as a consumer, including the legal warranty of quality under the Civil Code of Québec and the Consumer Protection Act of Québec, and the implied conditions under the sale of goods and consumer protection legislation of other provinces.

12. Limitation of Liability

12.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded or limited under applicable law, including under provincial consumer protection legislation.

12.2 Subject to section 12.1 and to the extent permitted by law, we are not liable for indirect, incidental, special or consequential losses, including loss of use, loss of profit, lost time, contractor costs, or costs of permits, foundations, electrical work, installation or removal, arising out of or in connection with the products or these Terms.

12.3 Subject to section 12.1 and to the extent permitted by law, our total liability for any claim arising out of an order is limited to the amount you paid for the products that gave rise to the claim.

12.4 We are not responsible for the acts or omissions of freight carriers, electricians, contractors or installers you engage, nor for damage caused by installation, use or maintenance contrary to our instructions.

13. Force Majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including severe weather, natural disasters, fire, flood, epidemic, labour disputes, transportation disruptions, raw material or component shortages, supplier failures, acts of government or public authorities, or failures of utilities or telecommunications. In such cases we will inform you and the time for performance will be extended by a reasonable period. If the delay is prolonged, either of us may cancel the affected order and we will refund any payment made for products not delivered.

14. Intellectual Property

The EG Pergola and EG Aluminum names and logos, and all content on the Services, including product designs, renders, photographs, text, drawings and installation guides, are owned by EG Aluminum or its suppliers and are protected by Canadian and international copyright and trademark law. You may download and print installation guides and product information for your personal use in connection with your purchase. Any other reproduction or commercial use requires our prior written consent.

15. Privacy

We collect and use your personal information in accordance with our Privacy Policy, which is incorporated into these Terms.

16. Governing Law and Disputes

16.1 These Terms and any contract formed under them are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws rules.

16.2 Subject to section 16.3, the courts of Ontario have jurisdiction over any dispute arising out of these Terms or an order, and you agree to submit to their jurisdiction.

16.3 If you are a consumer residing in Québec, nothing in these Terms deprives you of the protection of the Consumer Protection Act of Québec or the Civil Code of Québec, including your right to bring proceedings in the courts of Québec. Consumers in other provinces and territories retain the mandatory protections of their local consumer protection laws.

16.4 If a problem arises, please contact us first at info@egaluminum.ca or (548) 255-6022. Most concerns can be resolved quickly and informally, and we will work with you in good faith to find a solution before either of us takes formal steps.

17. General Provisions

17.1 These Terms, together with your order confirmation, any written quote and the policies referenced above, form the entire agreement between you and us for the sale of the products and replace any prior discussions or representations, other than those that cannot be excluded by law.

17.2 We may update these Terms from time to time. The version posted on the website at the time you place your order applies to that order.

17.3 If any provision of these Terms is found to be invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed, and the remaining provisions will continue in force.

17.4 Our failure to enforce any provision is not a waiver of our right to enforce it later.

17.5 You may not assign your rights under these Terms without our written consent. We may assign our rights and obligations to an affiliate or successor of EG Aluminum on notice to you.

17.6 These Terms are available in English. If a French version is provided and there is a conflict, the French version will prevail for consumers in Québec to the extent required by law.
