EG Aluminum (operating as EG Pergola) ("EG Pergola", "we", "us" or "our") operates the online store at https://egpergola.ca and the related content, tools, products and services (the "Services"). Our store is powered by Shopify. Our parent site is https://egaluminum.ca.

This Privacy Policy explains how we collect, use, disclose and protect your personal information when you visit the Services, request a quote, place an order, create an account or contact us. We comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws, including Québec's Act respecting the protection of personal information in the private sector (as amended by Law 25), Alberta's Personal Information Protection Act and British Columbia's Personal Information Protection Act.

If there is any conflict between our Terms and Conditions and this Privacy Policy, this Privacy Policy governs how personal information is handled.

1. Personal Information We Collect

"Personal information" means information about an identifiable individual. Depending on how you interact with us, we may collect:

Contact and quote form details – your name, email address, phone number, project details (for example, the pergola model, dimensions, colour and options you are interested in), your message, and the marketing source of your visit (UTM parameters and referrer URL).
Order information – billing and shipping address, the products ordered, order value, delivery instructions and order history. Payment card details are processed by Shopify Payments or the payment provider you select at checkout; we do not store full card numbers.
Customer account information – login email, password (stored in hashed form by Shopify), saved addresses and preferences, if you create an account.
Communications – emails, phone calls, chat messages, showroom appointment requests and other correspondence.
Reviews – the name, rating, text and photos you submit when you leave a product review through Judge.me.
Device and usage information – IP address, browser type, device identifiers, pages and products viewed, cart activity and links clicked, collected through cookies and pixels (see our Cookie Policy).

2. Where We Collect It From

Directly from you – when you submit a form, place an order, create an account, subscribe to emails, leave a review or contact us.
Automatically – through cookies and similar technologies when you use the Services.
From service providers – such as Shopify, freight carriers, analytics and marketing tools, and Judge.me.
From advertising platforms – such as Google, Meta, TikTok and Pinterest, which may tell us that you clicked one of our ads, subject to your choices on those platforms.

3. How We Use Your Personal Information

We use personal information only for the purposes identified when it is collected, or as permitted or required by law:

Providing and improving the Services

Preparing quotes and answering questions about your project;
Processing and fulfilling orders, including payment, production, shipping, delivery scheduling and returns;
Managing your account, cart and preferences, and communicating with you about your order, delivery and warranty;
Understanding how visitors use the site so we can improve it.

Marketing and advertising

Sending you newsletters, promotions and product updates by email where you have consented, in compliance with Canada's Anti-Spam Legislation (CASL);
Showing you relevant ads on Google, Meta (Facebook and Instagram), TikTok and Pinterest, including retargeting, where those pixels are enabled and you have accepted marketing cookies, and measuring campaign performance.

Security, fraud prevention and legal compliance

Authenticating accounts and protecting the Services from fraud and abuse;
Complying with tax, accounting, consumer-protection and other legal obligations;
Defending legal claims and enforcing our Terms and Conditions.

4. Consent

We collect, use and disclose personal information with your knowledge and consent, except where the law allows or requires otherwise. Consent may be express (ticking a box to receive our newsletter) or implied (providing your shipping address so we can deliver your order). You may withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice, by contacting info@egaluminum.ca. Withdrawing consent may mean we can no longer provide certain Services to you.

5. How We Disclose Personal Information

We do not sell your personal information. We may disclose it in the following circumstances:

Shopify and service providers – Shopify hosts our store and processes orders and payments (Shopify Payments). We also use providers for email delivery, analytics (Google Analytics through Shopify's Google & YouTube app), advertising (Google Ads, Meta, TikTok, Pinterest), reviews (Judge.me), freight and IT support. They may use your information only to perform services for us.
Freight carriers – we share your name, delivery address, phone number and email so the carrier can schedule and complete delivery.
Within EG Aluminum – between EG Pergola, EG Aluminum and our Ontario and Québec locations.
At your direction – for example, when you ask us to share a quote with your contractor.
Business transactions – if EG Aluminum or its assets are sold, merged or reorganized, to the successor, who will be bound by this Privacy Policy.
Legal requirements – where required by law, court order or lawful request, or to protect our rights, property or safety and that of our customers.

6. Transfers Outside Canada

Some of our service providers, including Shopify, Google, Meta, TikTok, Pinterest and Judge.me, store or process data outside Canada, including in the United States, where it may be accessible to the courts and authorities of that country. We use contractual and other safeguards to require providers to protect your information in a manner consistent with Canadian privacy law. Questions about transfers outside Canada or Québec can be sent to our privacy officer using the details below.

7. Shopify

Our store is hosted by Shopify Inc., a Canadian company that processes personal information about your use of our store to provide and improve its platform. Shopify may also use information about your interactions with our store and other Shopify stores for its own purposes, such as fraud prevention, for which Shopify is independently responsible. 8. Cookies and Analytics

We use cookies and pixels to run the store (cart, checkout, login), measure traffic through Google Analytics, and deliver and measure advertising through Google Ads, Meta, TikTok and Pinterest. Judge.me uses cookies to display and collect reviews. You can manage cookies through the store's cookie banner and your browser settings. Our Cookie Policy explains each category and how to opt out, including the Google Analytics opt-out add-on.

9. Third-Party Websites

The Services may link to websites we do not control, such as social media platforms or supplier sites. We are not responsible for their privacy practices and encourage you to read their policies. Content you post publicly, such as a review, may be visible to others.

10. Security and Retention

We protect personal information with safeguards appropriate to its sensitivity, including encrypted connections (TLS), access limited to staff who need the information, and the security built into Shopify's platform. No system is completely secure, so we cannot guarantee absolute security. Please do not send payment card numbers by email.

We keep personal information only as long as needed to complete your order, honour the warranty on your products, respond to requests and satisfy tax, accounting and other legal obligations. Quote requests that do not lead to an order are kept for a reasonable period so we can follow up on your project. When information is no longer required, we delete or anonymize it.

11. Your Rights

Subject to limits under applicable law, you have the right to:

Access the personal information we hold about you and learn how it has been used and disclosed;
Correct personal information that is inaccurate, incomplete or out of date;
Withdraw consent to the collection, use or disclosure of your information, including for marketing;
Request deletion of personal information that is no longer required for the purposes for which it was collected, or where we have no legal reason to keep it;
Portability – Québec residents may request computerized personal information they provided to us in a structured, commonly used technological format;
Unsubscribe from marketing emails using the link in each message. We will still send transactional messages such as order confirmations.

To exercise these rights, email info@egaluminum.ca or write to the address below. We may ask you to verify your identity. We will respond within 30 days, or explain if we need more time. We will not treat you differently for exercising your rights.

12. Children

The Services are intended for adults. We do not knowingly collect personal information from anyone under the age of majority in their province, or from minors under 14 without parental consent as required in Québec. If you believe a child has provided us with personal information, contact us and we will delete it.

13. Complaints

If you have a concern about how we handle your personal information, please contact our privacy officer first at info@egaluminum.ca. You also have the right to file a complaint with the Office of the Privacy Commissioner of Canada or, for Québec residents, the Commission d'accès à l'information du Québec, as well as the privacy commissioner of your province.

14. Changes to This Policy

We may update this Privacy Policy to reflect changes in our practices, tools or legal requirements. The revised version will be posted here with a new "Last updated" date, and we will give additional notice of material changes.
